This Privacy Policy details certain policies implemented throughout InTech Energy, Inc. (“InTech”) governing InTech’s collection and use of personally identifiable information about users of our Energy360® and PortfolioProPlus® services that we provide (“Services”).

Information Collection

In order to use our Services, we require you to submit your personally identifiable information to us. When you register to use our Services, you may be required to provide us with personally identifiable information such as your name, email address, and password. You also have the option to provide us with your phone number.

Information Use

We may use your personally identifiable information to deliver you our Services and information you have requested, verify your authority to enter certain password protected areas of the Services, and improve the content and general administration of the Services. If you are a user of our Services, we will use your personally identifiable information to provide the Services and support to you. We also will provide you with notifications about your account and your use of the Services.

Aggregate Information

The Services may track the total number of visitors to our Services and login times, External Web Sites (as defined below) linked to, browser type, IP addresses. Based on the specific Service, we also collect other non-personally identifiable aggregated information including, but not limited to, building and/or facility information, energy, water and waste use, occupancy, equipment installed, office hours, building holidays or aggregated energy savings information for measures deployed by utilities, energy programs and portfolios. We may use any of this non-personally identifiable aggregate information to analyze trends, administer the Services, track users’ movement, and gather broad demographic information for aggregate use. We may analyze this data for trends and statistics in the aggregate but such information will be maintained, used and disclosed in aggregate form only and it will not contain personally identifiable information.

Cookies and Online Tracking

We use persistent cookies. A persistent cookie remains on your hard drive for an extended period of time. You can remove persistent cookies by following directions provided in your Internet browser’s “help” file. You can read more about cookies at www.allaboutcookies.org. In our Services, we use persistent cookies to make it easier for you to navigate the Services and to improve and track the overall Services experience. For our Services, we set a persistent cookie to authenticate your login and authorization to use the Services. Persistent cookies also enable us to track and store your settings within the Services and unique identifiers that we establish of how the Services operate. If you reject cookies, you will not be able to use the Services.

InTech itself does not track users over time and over multiple websites and does not respond to browser do not track signals.

Children’s Privacy

InTech recognizes the privacy interests of children and we encourage parents and guardians to take an active role in their children’s online activities and interests. The Services are not directed to children under the age of 13. InTech does not target its Services to children under 13. InTech does not knowingly collect personally identifiable information from children under the age of 13. If we learn that a child under the age of 13 provided us with personally identifiable information, we will delete that information. If your child has provided personally identifiable information, please contact us so we can delete it. If you are under the age of 13, please do not provide us with any personally identifiable information.

Disclosure

We may provide your personally identifiable information and the data generated by cookies and the aggregate information to the vendors and service agencies that we may engage to assist us in providing our services to you and to our partners. Such third party entities may be obligated to use your personally identifiable information solely to provide the services to us. We will disclose your personally identifiable information if we reasonably believe we are required to do so by law, regulation or other government authority or to assist in any governmental or law enforcement investigation, to protect our or our users’ rights or to enforce our terms of use.
We will not sell your personally identifiable information to any company or organization except we may transfer your personally identifiable information in conjunction with a transaction such as a financing or to a successor entity upon a merger, consolidation or other corporate reorganization in which InTech participates or to a purchaser of all or substantially all of InTech’s assets to which the Services relates or in the event of a bankruptcy or related or similar proceedings.

Links to Third Party Sites and Third Party Integrations

The Services may provide links to other Web sites or resources over which InTech does not have control (“External Web Sites”). Such links do not constitute an endorsement by InTech of those External Web Sites. You acknowledge that InTech is providing these links to you only as a convenience, and further agree that InTech is not responsible for the content of such External Web Sites. Your use of External Web Sites is subject to the terms of use and privacy policies located on the linked to External Web Sites.
You may have separate agreements with other companies that use InTech technology. For example, you may separately engage with a third party to assist with your installation and/or support of InTech technology at your facility. Such third parties may collect and use your personal information in accordance with their own terms of use and privacy policies and their use is not governed under this InTech Privacy Policy.

Security

We employ industry standard procedural and technological measures that are reasonably designed to help protect your personally identifiable information from loss, unauthorized access, disclosure, alteration or destruction. InTech may use, without limitation, secure socket layer, encryption, password protection and other security measures to help prevent unauthorized access to your personally identifiable information.

Privacy Policy Updates

InTech may need to update this Privacy Policy from time to time. If so, InTech will post its updated Privacy Policy on our Services along with a change notice on the Services. InTech may also send users of our Services a notice that this Privacy Policy has been changed. InTech encourages you to review this Privacy Policy regularly for any changes. Your continued use of the Services and/or continued provision of personally identifiable information to us after the posting of such notice will be subject to the terms of the then-current Privacy Policy.

Notice to Users Outside of the United States

Our computer systems and third party hosting provider systems are currently based in the United States, so your personal data will be processed by us in the U.S. where data protection and privacy regulations may not offer the same level of protection as in other parts of the world, such as the European Union. In particular, you are advised that the United States of America uses a sectoral model of privacy protection that relies on a mix of legislation, governmental regulation, and self-regulation. Article 26 of the European Union’s Data Protection Directive (Directive 95/46/EC, 1995 O.J. (L 281) 31) allows for transfer of personal data from the European Union to a third country if the individual has unambiguously given his or her consent to the transfer of personal information, regardless of the third country’s level of protection. By using the Services, you agree to this Privacy Policy and to the processing of that information in the United States of America as described in this Privacy Policy.

Updating Personally Identifiable Information

InTech provides you with the ability to review, update and/or delete certain contact information that you provide to us by accessing your account or contacting us.
